What is ESIC?

About ESIC Registration in India

ESIC stands for Employee’s State Insurance Corporation, which is a statutory body under the Ministry of Labour and Employment, Government of India. ESIC provides social security benefits to employees working in factories and establishments in India, such as medical benefits, disability benefits, maternity benefits, and death benefits.

ESIC registration is mandatory for all employers who have 10 or more employees in their establishment. The registration process involves the following steps:

  1. Obtain the Employer Registration Certificate (ERC) by submitting the Employer’s Registration Form (Form-01) along with supporting documents such as a copy of the PAN card, a copy of the memorandum and articles of association, and a copy of the partnership deed (if applicable).

  2. Obtain the Employee Registration Certificate (ERC) by submitting the Employee’s Registration Form (Form-01) along with supporting documents such as a copy of the employee’s Aadhar card, a passport-sized photograph, and a copy of the bank passbook.

  3. Pay the ESIC contribution on a monthly basis, which is based on a percentage of the employee’s salary. The contribution is split between the employer and the employee, with the employer contributing 4.75% of the employee’s salary and the employee contributing 1.75% of their salary.

  4. Submit the ESIC returns on a half-yearly basis, which includes details such as the employee’s salary, the ESIC contribution made by the employer and the employee, and any changes in the employment status of the employees.

ESIC registration is important as it ensures that employees working in factories and establishments receive social security benefits such as medical care and disability benefits. It also helps employers comply with their legal obligations under the ESIC Act, 1948, and avoid penalties for non-compliance.

  5. Address Proof: A copy of the address proof of the establishment or factory, such as a rent agreement, lease agreement, or property tax receipt, is required for ESIC registration.

  6. List of Employees: A list of employees working in the establishment or factory, along with their Aadhaar card and bank account details, is required for ESIC registration.

  7. Photographs: Passport-sized photographs of the employer and employees are required for ESIC registration.

  8. Employee Salary Details: Details of the employees’ salary, including their basic pay and allowances, are required for ESIC registration.

  9. Other Documents: Any other documents that may be required by the ESIC authorities, such as the memorandum and articles of association, may also need to be submitted for ESIC registration.
